CANCELLATION POLICY:
Following your purchase of any program tuition, you have a 30-day grace period to cancel minus the $515 deposit (if applicable). There are no refunds, however, the amount can be transferred to another Dana Damara Evolution online program within one year.
NONDISCLOSURE AGREEMENT
THIS NONDISCLOSURE AGREEMENT (“Agreement”) between DANA DAMARA EVOLUTION a California company, and the person purchasing, an individual, relates to the mutual exchange of certain proprietary and/or confidential information between the parties or affiliates of the parties, which exchange the parties have determined to be in their mutual interests. As used in this Agreement, the term “Recipient” refers to either party upon receipt of such confidential information from the other, and includes any of the Recipient’s affiliates, officers, directors, employees, agents and representatives, including, without limitation, attorneys, accountants, consultants, and financial advisors (collectively, “Representatives”). The parties wish to protect their respective proprietary or confidential information being exchanged under this Agreement and, towards that end, hereby agree and represent to each other as follows:
- Confidentiality Agreement
It is understood and agreed to that the below identified discloser of confidential information may provide certain information that is and must be kept confidential. To ensure the protection of such information, and to preserve any confidentiality under patent and/or trade secret laws, it is agreed that:
- The Confidential Information to be disclosed can be described as and includes: technical and business information relating to proprietary ideas, trade secrets, curriculum, drawings and/or illustrations, existing and/or contemplated products and services, research and development, and business plans and models, regardless of whether such information is designated as “Confidential Information” at the time of its disclosure.
- Recipient agrees not to disclose, share, utilize or copy the information obtained from the discloser to anyone unless required to do so by law.
- This Agreement states the entire agreement between the parties concerning the disclosure of Confidential Information. Any addition or modification to this Agreement must be made in writing and signed by the parties.
- If any of the provisions of this Agreement are found to be unenforceable, the remainder shall be enforced as fully as possible and the unenforceable provision(s) shall be deemed modified to the limited extent required to permit enforcement of the Agreement as a whole.
The parties hereby acknowledge that they have read and understand this Agreement and voluntarily accept the duties and obligations set forth herein.
ASSUMPTION OF RISK, RELEASE OF LIABILITY & INDEMNITY AGREEMENT
I am physically able to participate in this exercise program, which may include yoga, meditation, stretching, strength training, and any other physical exercises provided by Dana Damara Evolution. I am aware and familiar with the fitness program provided by Dana Damara Evolution, including but not limited to yoga, and such activities may involve other risks. Dana Damara Evolution may suggest, movements, postures, or poses to the group, or assist me individually. Still, I understand that it is my responsibility and accountability to stop any positions beyond my physical limitations. I will only do actions and postures that my body is comfortable with; I will listen to my own body if any pain or discomfort arises. I will notify Dana Damara Evolution of any concerns immediately.
I am aware that by participating in this fitness program, I risk personal injury or possible death from many causes, which include (but are not limited to): (a) common injuries, including and not limited to, muscle strain and sprains, acute injuries, including and not limited to joint injuries, torn muscles, back muscles. I am aware that I risk catastrophic injuries as well, including and not limited to: stroke, heart attack, paralysis, or death. (B) misuse of failure of the facilities or any equipment; and (c) reliance upon other individuals (including staff of Dana Damara Evolution) to assist me in any way while participating in the fitness program or other physical activities.
